Action News 5: "Moratorium talk moves to Mississippi as Southaven residents sound data center alarm". Facts on this page cite the primary sources below, not the video.
Honest fence (read first): On Monday, Oct 19, U.S. District Judge Debra M. Brown (Northern District of Mississippi) signed a 22-page order in NAACP v. X.AI Corp. and MZX Tech LLC. That's the Clean Air Act lawsuit over the gas-turbine power plant in Southaven, Mississippi that feeds SpaceXSI's Colossus 2 data center across the state line in Memphis. The judge let the United States (for the EPA) join the case, but refused its request to dismiss it. That's all the order does. It does not decide whether the company violated the Clean Air Act, and it doesn't rule on the NAACP's request for a preliminary injunction. The company's own motion to dismiss is also still pending. We found no public statement from SpaceXSI on the ruling as of about 5 AM ET today. The emissions figures below come from the plaintiffs' lawyers, not from the court.
Editorial Thesis
SpaceX keeps telling investors that power is the real limit on its AI business, and that it can build power faster than anyone else. Southaven is where that speed is being tested in court. The Oct 19 order doesn't stop a single turbine. What it does is take away the fastest exit: the federal government can't make the case disappear by joining it and asking for dismissal. The power behind Colossus 2 now has to hold up in front of a judge, with neighbours watching.
Honest Verdict
Proven: the order exists, it's signed and dated Oct 19, and it denies the government's dismissal request while allowing it to intervene. Not proven: that the plant broke the law (no finding either way), that it will be shut down or limited (no injunction ruling), or the SELC's emissions totals (advocacy figures). Next real test: the government's filing deadline of Oct 23, any response by Oct 30, and whenever the judge rules on the company's motion to dismiss and the preliminary-injunction schedule.
What the order actually says
- Who's suing: the NAACP and the Mississippi State Conference of the NAACP. Who's sued: X.AI Corp. and MZX Tech LLC (the subsidiary local records tie to the Southaven site). The company has since been renamed under SpaceX, first SpaceXAI, now SpaceXSI. The case caption still uses the old names.
- The claim: that the defendants built and ran the "Colossus Gas Plant," made up of gas-fired combustion turbines, without a permit, in violation of the Clean Air Act and Mississippi's State Implementation Plan.
- What the plaintiffs want: an order barring operation except under the Clean Air Act, the best available pollution controls, civil penalties of up to $124,426 per day per violation, and costs. They asked for a preliminary injunction on June 12.
- What the government asked for: on June 15 (amended July 7), the United States moved to intervene on behalf of the EPA Administrator and then dismiss the whole case.
- The ruling, in the judge's words: the EPA Administrator "is entitled to intervene in Clean Air Act citizen suits but nothing in the Clean Air Act allows the Administrator to unilaterally dismiss a citizen suit upon intervention."
- On national security: the government argued dismissal fit "federal policy, national security, and the public interest," and pointed to federal use of Grok in national-security and military work (as reported by Action News 5). The judge wrote that the Court "does not consider the United States' national security concerns relevant" to the question in front of it.
- The Fifth Circuit side-trip: the government had appealed what it called a "constructive" denial and asked the appeals court to pause the case. The Fifth Circuit denied that stay, noting the district court "has not fully determined this issue." Now it has.
The dates that matter next
- Oct 23, 2026: deadline for the United States to file a formal pleading if it wants to take part as an intervenor.
- Oct 30, 2026: deadline for any response to that pleading.
- No date yet: the judge says the company's June 15 motion to dismiss and a June 19 motion about preliminary-injunction hearing deadlines "will be addressed by separate order."
The permit question, in plain English
According to DeSoto County News, Mississippi's environmental regulator (MDEQ) issued an air permit for 27 gas-fired turbines at the site in March 2026. The lawsuit focuses on the period before that permit, when the plaintiffs say turbines were already running. So "they have a permit now" and "they ran without one before" can both be true. That's exactly what the case will test. The plant sits at 2875 Stanton Road S. in Southaven.
What the plaintiffs claim (and how to read it)
The Southern Environmental Law Center, which represents the NAACP with Earthjustice, says the plant "is able to emit over 5,000 tons of nitrogen oxides (NOx) each year," plus more than 400 tons of fine particulate matter and more than 47 tons of formaldehyde. Read those as potential-to-emit claims from the side bringing the case. They aren't court findings or measured totals. Quotes from the plaintiffs' side:
- Abre' Conner, NAACP: "The court made clear today that the law applies to everyone, including the federal government."
- Patrick Anderson, SELC: "a major step toward protecting communities in North Mississippi and Memphis."
Why it matters to SpaceXSI right now
On the Oct 20 earnings call, Musk said he's been in Memphis "often four days a week, night and day, just getting the Memphis Supercompute cluster Colossus II online." He said "the constraint on deployment of super intelligence is more in power and cooling and infrastructure than it is in chips," and that SpaceX is now "casting the blades and vanes for the turbines" because those parts are the bottleneck. CFO Bret Johnsen said SI infrastructure is "continuing to come online at Memphis and Southaven." (We're not repeating the quarter's financial numbers here. They're in today's separate investing post.)
That's the business case. The Southaven order is the community and legal side of the same turbines. For scale, the independent tracker Epoch AI estimates Colossus 2 at roughly 946 MW of IT power. That's an estimate built from satellite imagery, permits and disclosures, not a company figure, and Epoch's site page still dates its latest imagery to June.
Same week in Southaven
- Oct 17 (Daily Memphian, via DeSoto County News): county records show MZX Tech bought three homes near the power plant. Another lien has been filed against the company (amount and filer not public in what we could read). The company is also leasing a distribution building on U.S. Highway 51.
- Oct 20 roundtable (Action News 5): residents told Sen. Sheldon Whitehouse and Senate candidate Scott Colom about noise ("mistaken... for a plane hovering overhead"), property values and power bills. State Sen. Theresa Gillespie Isom said some homeowners called the buyout offers "pennies." Colom wants a temporary pause on new data centers until companies meet five conditions, including paying their own utility costs and making deals public. Sen. Cindy Hyde-Smith's campaign said she shares the concerns and pointed to the Ratepayer Protection Act. Memphis leaders are weighing a moratorium too.
- Southaven's mayor has previously called the company a good corporate citizen for offering buyouts. Both views are on the record.
Claim vs proof
| Claim | Receipt | Status |
|---|---|---|
| DOJ can't end the case by intervening | Oct 19 Opinion and Order, Doc 135 | Proven (court order) |
| EPA is now part of the case | Same order: intervention granted | Proven; must file by Oct 23 |
| The plant violated the Clean Air Act | Plaintiffs' complaint | Alleged, not decided |
| 5,000+ tons NOx a year possible | SELC release | Plaintiffs' claim |
| Turbines will be shut down | No injunction ruling | Not happening yet |
| Company is buying homes nearby | County records via Daily Memphian / DCN | Reported, three homes |
| National security justifies dismissal | DOJ filing (reported) | Judge: not relevant to this question |
What to watch next
- Whether the United States files its Rule 24(c) pleading by Oct 23, and what position it takes as a party.
- The judge's separate orders on the company's motion to dismiss and the preliminary-injunction schedule.
- Any SpaceXSI statement or filing response.
- Memphis and Mississippi moratorium votes, and whether more buyouts close.

Action News 5 (WMC, Memphis), "Moratorium talk moves to Mississippi as Southaven residents sound data center alarm" (vV9_NSlLhHc), uploaded Tue Oct 20, 9:40 PM ET, 2:41. It's a local TV report on the roundtable that closes on the NAACP ruling. It shows residents and officials, not the court order, so use the order for the legal facts.
